2. Requirements for a Valid DMCA Notification

3. Removal of Infringing Material

The claims of both the complaining party and the original poster will then be referred to the U.S. Copyright Office for adjudication under the DMCA.

4. Counter-Notification

If you believe that content you posted was removed in error, you may submit a counter-notification under the DMCA. To be effective, the counter-notification must include:

  1. Your physical or electronic signature.
  2. Identification of the material that has been removed or disabled, and the location of the material before it was removed.
  3. A statement, under penalty of perjury, that you have a good faith belief the material was removed or disabled due to a mistake or misidentification.
  4. Your name, address, and phone number, along with a statement that you consent to the jurisdiction of the Federal District Court for the judicial district where your address is located (or, if outside the U.S., for any judicial district where AnimeCharming.com may be found), and that you agree to accept service of process from the complaining party or their agent.

5. Required Statements

By submitting a DMCA notification, you affirm and agree that:

  • I have a good faith belief that the content described above violates my rights or the rights of the copyright holder, and that the use of such content is not authorized by law.
  • I declare, under penalty of perjury, that the information provided in this notification is accurate and that I am the copyright owner or authorized to act on the copyright owner’s behalf.
